From Deference to Deliberation

Team members Loza Taye, Rebecca Critser, and Akosua Dufie wrote an article for The Enviromental Forum about the Loper Bright Enterprises v. Raimondo decision and its impact on federal agency’s ability advocate for regulation interpretation. This decision shifts the authority to interpret scientific and technical language from administrative organizations such as Environmental Protection Agency (EPA) to the federal courts. The article details the ways in which administrative agencies operated under Chevron precedent, the impact the Loper Bright decision would have on regulatory decisions going forward, and the need for these agencies to bolster their rulemaking processes in the face of an everchanging regulatory landscape.
